On July 31st 2019, an Application for Authorization to Institute a Class Action is filed into the court record at the Superior Court of Québec against companies NHK SPRING Co., LTD., NHK INTERNATIONAL CORPORATION, NAT PERIPHERAL (HONK KONG) Co., TDK CORPORATION, TDK U.S.A. CORPORATION, TDK CORPORATION OF AMERICA, SAE MAGNETICS (HK) LTD., MAGNECOMP PRECISION TECHNOLOGY PUBLIC Co. LTD. and HUTCHINSON TECHNOLOGY INC. for breaching their legal and statutory obligations, in particular by conspiring to unduly restrict competition and fix, maintain, increase and unreasonably control the price of hard disk drive (HDD) suspension assemblies (the "Suspension Assemblies")..

WHAT ARE SUSPENSION ASSEMBLIES?

A Suspension Assembly is one of the components of a hard disk drive (HDD).

The purpose of a hard disk drive is to store information using magnetic recording heads that read from, or write data onto, the surface of spinning magnetic disks. The function of a Suspension Assembly is to hold the recording heads in close proximity to the disks and provide the electrical connection from the recording heads to the hard disk drive’s circuitry.

Hard disk drives, including Suspension Assemblies, are incorporated in a wide variety of electronic products including, in particular, office computers, laptops, gaming consoles, personal digital recorders, (or HDD decoders) and camcorders. Hard disk drives, including Suspension Assemblies, are also used in certain stand-alone storage devices.

WHO IS A CLASS MEMBER?

Any person who, between May 1, 2008 and April 30, 2016, purchased in Québec one or more Suspension Assemblies or one or more products equipped with Suspension Assemblies.

WHAT STAGE HAS THE CLASS ACTION REACHED?

The class action is currently at the authorisation stage.
