LEGAL NOTICE OF COURT APPROVAL OF VOLKSWAGEN, AUDI and PORSCHE 3.0L DIESEL EMISSIONS SETTLEMENT IN CANADA

Courts have approved a nationwide settlement in Canada to benefit many current and former owners and lessees of the following 3.0-litre diesel vehicles originally sold or leased in Canada:

Generation One Vehicles

Generation Two Vehicles

VW Touareg, 2009-2012

VW Touareg, 2013-2016

Audi A6, 2014-2016

Audi Q7, 2009-2012

Audi Q5, 2014-2016

Audi A7, 2014-2016

Audi Q7, 2013-2015

Audi A8/A8L, 2014-2016

Porsche Cayenne, 2013-2016

YOU MAY BE ELIGIBLE FOR BENEFITS UNDER THE SETTLEMENT IF YOU OWNED OR LEASED ONE OF THESE VEHICLES ON NOVEMBER 2, 2015 OR IF YOU CURRENTLY OWN ONE OF THESE VEHICLES.
IF YOU SOLD OR SELL YOUR VEHICLE ON OR AFTER JANUARY 17, 2018, YOU ARE NOT ELIGIBLE FOR BENEFITS.

3.0L SETTLEMENT BENEFITS FOR GENERATION ONE VEHICLES

Generation One vehicles cannot practically be brought into compliance with the emissions standards to which they were originally certified. If approved by U.S. regulators, a modification will become available through recall in Canada to reduce the emissions of these vehicles. If you are an eligible owner or lessee of an eligible Generation One vehicle, YOU MAY CLAIM:

  • Buyback + Cash –OR– Trade-In toward purchase of replacement new or used VW / Audi vehicle from a VW or Audi dealership in Canada + Cash –OR– Reduced Emissions Modification with Extended Emissions Warranty + Cash if you owned your vehicle on November 2, 2015 and continue to be the owner
  • Reduced Emissions Modification with Extended Emissions Warranty + Cash if you purchased your vehicle after November 2, 2015 and continue to be the owner
  • Early Lease Termination + Cash –OR– Reduced Emissions Modification with Extended Emissions Warranty + Cash if you held a lease on your vehicle on November 2, 2015 and continue to be in your lease
  • Even if you no longer own or lease your vehicle, you may be eligible for Cash

3.0L SETTLEMENT BENEFITS FOR GENERATION TWO VEHICLES

A repair has been approved by U.S regulators to bring all Generation Two vehicles into compliance with the emissions standards to which they were originally certified. The repair is available through recall in Canada. If you are an eligible owner or lessee of an eligible Generation Two vehicle, YOU MAY CLAIM:

  • Emissions Compliant Repair with Extended Emissions Warranty + Cash if you continue to own or lease your vehicle
  • Even if you no longer own or lease your vehicle, you may be eligible for Cash

HOW DO I MAKE A CLAIM?

  • The period for submitting a claim begins on May 8, 2018 and runs until May 31, 2019.
  • If your claim is approved, you will have until August 31, 2019 to receive your benefits.
  • You may submit a claim online through www.VWCanadaSettlement.ca.
  • Alternatively, you may complete a paper claim form available at www.VWCanadaSettlement.ca and submit your form by mail to the address indicated on the form.

The Courts will approve legal fees to class counsel. Those amounts will be paid separately and will not reduce the Settlement benefits.
