NOTICE OF CLASS ACTION AUTHORIZED BY THE SUPERIOR COURT
(Lucie Ladouceur v. Société de Transport de Montréal, 500-06-000451-084)

YOU ARE A CAM-HOLDER FOR THE MONTH OF MAY 2007?

PLEASE READ THE FOLLOWING CAREFULLY .

A settlement has been concluded in the class action instituted against the Société de Transport de Montréal (STM) with respect to the transit strike that took place in May 2007.

If the Superior Court approves this settlement, the STM will pay to the benefit of the class members an amount of more than 1 million dollars which will be used essentially to reduce the price of all its monthly transit passes for the month of September 2015.

If you are part of this class action, you can benefit from this price reduction. You can also contest the settlement or class counsel fees.

WHO IS PART OF THE CLASS ACTION?

You are part of this class action if, during the month of May 2007, you were the holder of a regular or reduced-fare CAM.

WHAT DOES THE SETTLEMENT PROVIDE ?

If the settlement is approved by the Superior Court, every public transit user will benefit from a 2,25$ price discount on the regular-fare monthly transit pass for the month of September 2015, or a 1,25$ price discount on the reduced-fare monthly transit pass for the same month.

The STM also undertakes to distribute free transit passes, for a value of approximately $50,000, to a disadvantaged clientele of the Montreal agglomeration.

Finally, a quarter of the total value of the settlement will be used to pay class counsel fees. Class counsel’s disbursements will also be paid with the settlement amount, up to a maximum of $12,804.10, plus taxes.

IS THERE A COST FOR THE CLASS MEMBERS ?

No, it costs nothing.

WHAT DO THE CLASS MEMBERS HAVE TO DO IN ORDER TO BENEFIT FROM THE SETTLEMENT ?

They just have to purchase a regular or reduced-fare monthly transit pass offered by the STM for the month of September 2015. The price reduction will automatically be applied at the time of purchase.

WHAT CAN YOU DO IF YOU DISAGREE ?

If you are part of this class action, you can contest the settlement and class counsel fees:

To contest, you must write to class counsel and explain why the settlement and/or class counsel fees should not be approved by the Superior Court.

You must send your letter by registered or certified mail before May 25, 2015, to the following address:

Belleau Lapointe LLP

306 Place D’Youville, suite B-10

Montreal (Qc) H2Y 2B6.

The letters received will be forwarded to the Superior Court.

WHAT WILL HAPPEN NEXT ?

The Superior Court will hold a hearing to decide whether it should approve the settlement. You may attend the hearing, which will take place in room 15.07 of the Montreal Courthouse on May 29, 2015, at 9:00am.

If you wish to make an oral statement during the hearing, you must have transmitted your written statement to class counsel before the deadline.
