WHAT IS THIS CLASS ACTION ABOUT?

In October 2010, Option consommateurs filed a class action against certain companies regarding a conspiracy to artificially inflate the price of flexible polyurethane foam made in Canada.

WHO IS A CLASS MEMBER?

Any person or company, resident of Quebec, who:

  • bought flexible polyurethane foam and/or Products containing flexible polyurethane foam in Canada;
  • between January 1st 1999 and January 10th 2012;
  • excluding companies which had more than 50 employees between October 1st 2009 and October 1st 2010, the defendants and all persons related to them.

WHAT PRODUCTS ARE COVERED BY THE PRESENT CLASS ACTION?

All products containing flexible polyurethane foam are covered by the present case, including:

  • Upholstered furniture;
  • Mattresses; and
  • Carpet underlay made of flexible polyurethane foam.

WHAT STAGE HAS THE CLASS ACTION REACHED?

Up to now, the Courts have approved settlement agreements totaling over $38,000,000 collected on behalf of class members. Additional sums may also still be received.

The Claims Administrator expects to begin distributing sums to class members in the summer and fall of 2018.

WHEN MUST MEMBERS SUBMIT THEIR CLAIMS?

The class members had until February 6, 2018 to file their claim.

CAN I EXCLUDE MYSELF FROM THE CLASS ACTION?

No, the deadline to opt-out of the class action has now passed.
