Class action

Option consommateurs filed a class action against Samsung regarding Samsung and Kenmore top-loading washing machines. Option consommateurs alleges that Samsung manufactured, marketed and sold clothes washers with a latent defect that can cause abnormal vibrations in the machine and even an explosion. In order to protect themselves from these risks, the members of the group are forced to restrict the use of their washing machines considerably. Option consommateurs finally alleges that the recall process put in place by the defendants is insufficient because it does not allow for the resolution of the problem observed, nor does it adequately compensate the members. 

The class action seeks to obtain a judgment ordering the reimbursement of the purchase price of the washers to the members of the group. The action also seeks a reimbursement of $200 per member as damages and the payment of $5 million in punitive damages.

You are a member of the class action if you have purchased, in Québec, one of the following models of top-loading washing machines:

The following Samsung top-loading washer models manufactured from March 2011 to April 2016:

WA5471ABP/XAA, WA5451ANW/XAA, WA5451ANP/XAA, WA422PRHDWR/AA, WA456DRHDSU/AA, WA456DRHDWR/AA, WA50F9A8DSP/A2, WA45H7200AP/A2, WA45H7200AW/A2, WA45H7000AW/A2, WA48J7770AW/A2, WA52J8700AP/A2.

The following Samsung top-loading washer models manufactured from March 2011 to June 2016:

WA40J3000AW/A2, WA56H9000AP/A2.

The following Samsung top-loading washer models manufactured from March 2011 to October 2016:

WA50K8600AV/A2, WA45K7600AW/A2.

The following Kenmore top-loading washer models manufactured from March 2011 to April 2016:

592-29212, 592-29222, 592-29227, 592-29336.

What is the status of this class action?

On July 6, 2018, Option consommateurs filed an Originating application to Institute Proceedings in the Québec Superior Court. 

The case is currently proceeding to the merits stage.
